Ninety Days, Not Thirty

If the department cancelled your registration, you can apply to have it restored in Form REG-21. The window is ninety days from the date of service of the cancellation order, under Rule 23 as substituted by Notification 38/2023-Central Tax with effect from 1 October 2023. A great deal of material online still says thirty days, which was the position before that change. Before you can apply, every pending return must be filed and the dues paid, because the default that caused the cancellation has to be cured.

Who can apply

Only where the cancellation was suo motu, that is, initiated by the officer.

If you applied for cancellation yourself in Form REG-16 and the officer accepted it, revocation is not available. The route back is a fresh registration.

This single distinction decides the answer for most people who search this.

The time limit

Position

Window

From 1 October 2023

90 days from service of the cancellation order

Before 1 October 2023

30 days, with two further extensions of 30 days each

Sources also describe an extension beyond ninety days on sufficient cause, with one referring to a practical outer limit reaching 270 days. Do not plan on the extension. Treat ninety days as the deadline.

What has to happen before you apply

Revocation is not granted to a taxpayer still in default. Before filing REG-21:

  1. File every return outstanding for the period up to the effective date of cancellation

  2. Pay the tax, interest, penalty and late fee due

  3. Where the cancellation was for non-filing, the returns are the cure

The process

  1. Clear the returns and dues

  2. Log in and open the application for revocation of cancelled registration

  3. State the grounds and attach supporting documents

  4. Submit Form REG-21 with a digital signature or EVC

  5. The officer may issue a notice seeking clarification, which is answered within the stated period

  6. On approval, a revocation order is issued and the registration is restored

Sources report that after revocation, returns for the period from the cancellation order, or from the effective date where cancellation was retrospective, to the date of the revocation order must be filed within thirty days of that order.

If revocation is refused

Sources report an appeal to the Appellate Authority in Form APL-01 within thirty days of the rejection order.

If the window has gone

Where the ninety days have passed and no extension is available, the practical route is a fresh registration. Before that, outstanding dues must be cleared and the final return in GSTR-10 filed, because a new registration does not discharge the old one’s obligations.

Why speed matters commercially

While cancelled, you cannot issue valid tax invoices, your customers cannot claim credit, and the portal blocks much of what you need to operate. Every week of delay is a week of trading difficulty, quite apart from the deadline.
